REAL ESTATE AGENCY. Assistance in the purchase of a property in Italy. House buying in Italy varies from region to region as far as local and planning regulations go. It is usual to appoint a public notary (the notary is a public official) to act for both the seller and the buyer. He gathers all the necessary documents, checks the title deeds and the legal registration of the property as well as such important information as the legality of any buildings on the land. Our real estate agency also puts at disposal a surveyor who is on the staff and an interpreter for the preparation and the translation of the technical documents needed by the notary. Along with the staff of our agency you find the house you would like to buy, sign a private contract, called agreement to sell (promise of sell or of purchase). It is a preliminary agreement to sell setting out the sale conditions such as the planning permission, mortgage and loan details, if applicable, as well as the date for the completion of the transfer of the property. This document is authenticated and the purchaser pays a deposit of 10% - 30% of the price. If you back out of the agreement for reasons not covered in the agreement to sell the deposit is not returnable. At the same time, the seller has to pay you double the deposit if he backs out of the sale or does not keep to the agreement. The Italian name for the deposit is caparra.
